Vendor Terms and Conditions
1. Introduction
Welcome to The Market at Harbourside Place! These terms and conditions outline the rules and regulations for vendors participating in the market. By applying to become a vendor, you agree to comply with these terms.
2. Vendor Eligibility
- Requirements: Vendors must offer products that align with the market’s vision of showcasing local artisans, food producers, and small businesses. All vendors must have the appropriate permits and licenses required to sell their products.
- Application Process: Interested vendors must complete the application form and submit it by the specified deadline. A non-refundable application fee of $40 is required. Applications must include photos of products and a business description.
3. Vendor Obligations
- Compliance: Vendors must adhere to all local, state, and federal regulations, including health and safety standards.
- Insurance: Vendors must provide proof of general liability insurance. Harbourside Place must be named as an additional insured.
- Payment: All vendor fees must be paid in full by the Wednesday prior to the market. Accepted payment methods include online payment portal. Late payments may result in forfeiture of the vendor's spot.
- Setup and Breakdown: Vendors may begin setting up at 8 AM and must be fully operational by 9:30 AM. Breakdown begins no earlier than 3 PM, and all booths must be cleared by 4 PM. Vendors are responsible for leaving their space clean and free of debris.
- Attendance: Vendors are expected to attend all market dates they commit to. If a vendor cannot attend, they must notify the organizers at least 3 days in advance.
4. Market Rules
- Hours of Operation: The market operates from 10 AM to 3 PM. Vendors must be ready to sell at the opening time and remain open until the market closes.
- Product Guidelines: Vendors may only sell items listed in their application unless approved by the organizers. No counterfeit goods or items that violate local laws are permitted. All food vendors must comply with health department regulations.
- Booth Space: Booth spaces are 10'x10' and will be assigned by the organizers. Vendors may not extend their display beyond their designated space without prior approval. Displays must be professional and not obstruct other vendors or walkways.
- Conduct: Vendors must maintain a professional demeanor at all times. Disruptive behavior, including excessive noise or conflicts with other vendors or customers, will not be tolerated.
- Noise and Disturbances: Vendors may not use amplified sound without prior approval. Any activities that may disturb other vendors or the public are prohibited.
5. Liability and Indemnification
- Organizer Liability: Harbourside Place and its organizers are not liable for any damage, theft, or injury that occurs at the vendor’s booth. Vendors participate at their own risk.Vendor Liability: Vendors agree to indemnify and hold harmless Harbourside Place, its affiliates, and agents from any claims, damages, or liabilities arising from their participation in the market.
6. Cancellations and Refunds
- Weather Policy: The market will proceed rain or shine. In the event of severe weather, the market may be canceled or rescheduled at the organizers’ discretion. No refunds will be issued for weather-related cancellations.
Refunds: Vendor fees are non-refundable unless the market is canceled by the organizers for reasons other than weather.
7. Termination
- Breach of Terms: Any violation of these terms may result in immediate removal from the market without a refund. Repeated violations may result in a permanent ban from future markets.
Discretionary Termination: The organizers reserve the right to terminate a vendor’s participation at their discretion for any reason deemed necessary for the success of the market.
8. Dispute Resolution
- Process: Any disputes between vendors or between a vendor and the organizers should be resolved amicably. If a resolution cannot be reached, the matter will be referred to the market director for a final decision.
9. Amendments
- Modifications: The organizers reserve the right to amend these terms and conditions at any time. Vendors will be notified of any changes via email.
10. Acceptance of Terms
By submitting an application and participating in The Market at Harbourside Place, the vendor acknowledges that they have read, understood, and agree to abide by these terms and conditions.
